End User Agreement, Terms, Conditions, & Services The following outlines an implicit agreement between Playlist LLC ("StreamStakes") and you, the user of its services. Playlist LLC provides customer compliance, contest, and validation services (the "Service") as described in the outline below. This user agreement also serves as notice to all users regarding usage policies for these services.

By proceeding with the use of this service, you provide your consent to the use of these services consisting of device recognition and identifier technologies, identity authentication, and location verification in accordance with the terms of this policy.

By using Playlist LLC, you agree to be bound by the following terms and conditions ("Terms of Service"). Any new features or tools added to the current Service shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on the Service Provider’s website. The Service Provider reserves the right to update and change the Terms of Service by posting updates to the website. When returning to a merchant website that utilizes the Service Provider Service or logging into your account, you will be alerted if the Terms of Service have changed.

The Service

The Service Provider (Playlist LLC) transmits necessary identity authentication and location information, as required by this website. By enrolling in the Service, you agree to have your location (including your cell phone/mobile device location) and other identifying information logged and used for account authentication. Each time this occurs, some or all of the following information may be authenticated: your identity, location, service approval, activity, and/or financial transaction approval. This information is stored securely and used to ensure compliance with the parameters of the website and the service being accessed, as required by law and the terms and conditions of this site.

Use of Data

Your data will be used by the Merchant and Service Providers to execute the functions of the Service. Data provided by the End User and/or Merchant, as well as any data collected as part of the Service’s functions, may be shared with third-party partners. All identity, location, financial, device, or other data is transmitted via Secure Socket Layer (SSL) technology into password-protected servers. This information aids the Service Provider in delivering its services. Specific data connected with financial transactions between the End User and Merchant is not shared with other parties unless stated. This data may also be used to update and enhance the End User’s profile.

Third-Party Software/Service Providers

We may use UXCam, an analytics solution that may record: screens visited, interaction patterns (such as taps and scrolls), and device details (type, version, model, OS). This information is used to improve our app. UXCam does not collect personally identifiable information and does not track your browsing habits across apps. Licensed Metadata & Artwork

StreamStakes integrates metadata—including artist names, album titles, track names, and associated artwork—provided by Music Story SAS (“Music Story”). This metadata remains the exclusive property of Music Story and/or its rights holders. Artist-related content is displayed dynamically through an API integration and not hosted or stored by StreamStakes. Users are strictly prohibited from downloading, modifying, redistributing, or broadcasting this content. All such material is intended solely for personal and private use within the context of StreamStakes’ entertainment-based services. StreamStakes does not claim ownership over any artist names, imagery, or artwork. All trademarks and copyrights remain with their respective owners. The inclusion of third-party artist content does not imply endorsement or affiliation by the artists, their labels, or any rights holders. Screenshots or promotional visuals that include artist images are strictly for the purpose of UI demonstration and product education. These assets are not intended to imply commercial use, artist endorsement, or promotional affiliation.

Content Ownership & Display Rights

Users acknowledge that third-party content displayed on the platform, including artist names, likenesses, album artwork, and track information, remains the intellectual property of the original rights holders. StreamStakes displays this content under limited license agreements for informational, entertainment, and non-commercial use. No license or ownership rights are granted to users. StreamStakes does not use any artist imagery, likenesses, or associated metadata provided by Music Story for external marketing or paid advertising purposes, including but not limited to digital ads, Meta Ads, TikTok promotions, or influencer campaigns. Such usage is restricted by our licensing agreements.

Marketing & Advertising Compliance

Any paid advertisements, influencer posts, or promotional content created by or on behalf of StreamStakes must comply with applicable advertising guidelines, including but not limited to FTC disclosure requirements, Meta Ads policies, and platform-specific rules. Disclosures of material connections (e.g., #ad, #sponsored) must be clearly visible when applicable.

StreamStakes reserves the right to review, approve, or remove any third-party content, influencer campaign, or user-generated promotion that includes StreamStakes branding, UI screenshots, or references to contests.

Screenshot Usage for Promotional Purposes

Screenshots that display the StreamStakes user interface, including visuals of artist matchups or album artwork, may be shared for promotional purposes (e.g., website walkthroughs, email campaigns, product tours) only when clearly marked as a demo or example. These materials must not be used to imply partnership, commercial licensing, or artist involvement in StreamStakes.

Data Source Acknowledgment

StreamStakes relies on third-party data sources, including but not limited to publicly available streaming metrics from platforms such as Spotify. The stream counts displayed within StreamStakes are provided “as is” and may be subject to delays, rounding adjustments, data retrieval errors, or discrepancies compared to third-party platforms.

Limitation of Liability for Data Discrepancies

Due to potential delays, rounding adjustments, data retrieval errors, or discrepancies between the data displayed in the StreamStakes platform and that shown on external sources (e.g., music streaming services, media outlets, or other reporting tools), StreamStakes shall not be held responsible for any perceived inaccuracies. Users acknowledge that streaming data may be subject to real-time updates, reporting delays, or differences based on regional availability, and as such, StreamStakes disclaims all liability for any reliance on such figures in connection with contest outcomes, payouts, or other game-related activities.

Finality of Contest Results

By participating in StreamStakes contests, users agree that all contest results are final and determined based on the data recorded within the StreamStakes system at the time of contest resolution. Contest outcomes cannot be disputed, modified, or adjusted based on updated or external data. StreamStakes reserves the right to cancel, modify, or adjust contests due to technical malfunctions, fraudulent activity, or data reporting errors to maintain fairness and integrity.

Third-Party Content: Music Story Data Providers

StreamStakes is not the creator, owner, or licensor of the artist-related metadata displayed within the app. All artist names, images, and associated artwork are provided by Music Story SAS. Their inclusion does not imply endorsement or partnership with featured artists, labels, or other entities. The metadata, images, and other content provided via Music Story’s API may change or become unavailable at any time. StreamStakes is not responsible for discrepancies in artist data or visual assets and assumes no liability for any outdated, missing, or incorrect information.

Promotional assets that contain elements of Music Story metadata must remain within the platform or official product walkthroughs. External paid media must not reuse Music Story-derived content, including screenshots containing artist likenesses.

Third-Party Platform Compliance

Users, affiliates, or contractors representing StreamStakes in any promotional capacity agree to comply with all advertising policies and promotional terms of the third-party platforms where the content is displayed. This includes, but is not limited to, Meta Ads, TikTok, Google, and other digital ad platforms.

Music Story Data Usage & Liability

StreamStakes makes no claim of ownership over the artist images, track listings, or album artwork displayed within the app. Users are prohibited from copying, distributing, or otherwise exploiting this content outside of its intended use within the StreamStakes platform. In the event that a record label, rights holder, or other entity raises a legal claim related to the use of artist metadata or artwork, Music Story shall be responsible for addressing such claims, as StreamStakes solely displays content provided through its licensed API. Users acknowledge that all disputes regarding metadata accuracy, ownership, or licensing must be directed to Music Story or the respective rights holder.

Release of Responsibility

Users expressly release StreamStakes, its affiliates, officers, employees, and partners from any claims, liabilities, or damages arising from perceived inaccuracies in streaming data, discrepancies in reported stream counts, or any resulting financial, emotional, or reputational losses.

Fraud Prevention & Account Restrictions

StreamStakes enforces strict fraud prevention measures to maintain its contests' integrity. Users are prohibited from creating multiple accounts, and any attempt to do so may result in the permanent suspension of all associated accounts and forfeiture of winnings. The use of automated tools, including bots, scripts, AI-based selection tools, or other methods designed to manipulate contest outcomes, is strictly forbidden. StreamStakes reserves the right to request identity verification, including government-issued identification or address verification, before processing withdrawals or allowing continued participation. If StreamStakes detects suspicious activity, such as coordinated entries, account sharing, or collusion, the Company reserves the right to freeze accounts, withhold winnings, or void contest results pending investigation. Users found in violation of these policies may have their accounts permanently terminated, and funds forfeited.

Contest Cancellation & Adjustments

StreamStakes reserves the right to cancel, modify, or adjust contests at its sole discretion. This includes, but is not limited to, situations where a technical malfunction, data retrieval error, or third-party service outage affects the accuracy or fairness of a contest. Contests may also be canceled if fraudulent activity, collusion, or unfair play is suspected. Additionally, if force majeure events, such as natural disasters, cyberattacks, or regulatory orders, prevent the normal operation of the platform, StreamStakes may modify, delay, or cancel contests as necessary. In cases where contests are canceled before completion, entry fees (if applicable) will be refunded, but StreamStakes is not responsible for any financial losses incurred as a result of such cancellations.

Withdrawal & Payment Terms

StreamStakes provides secure withdrawal processing for contest winners, subject to identity verification and compliance reviews. Users may withdraw funds at any time, provided that the minimum withdrawal amount is $5. Withdrawals below this amount will not be processed unless the user is closing their account. Withdrawals will generally be processed within 10 business days, though delays may occur due to bank processing times, compliance checks, or fraud investigations. StreamStakes reserves the right to withhold, delay, or deny withdrawals if suspicious activity, unauthorized access, or violations of these Terms are detected. For withdrawals over $25, StreamStakes may cover transaction fees, depending on the selected payment method. Users acknowledge that frequent small withdrawals may be subject to additional processing delays or fees. By initiating a withdrawal, users waive the right to dispute or reverse payments through chargebacks. Any attempt to initiate fraudulent chargebacks or payment disputes may result in account termination, forfeiture of winnings, and legal action to recover disputed funds.

Responsible Play & Age Restrictions

Participation in StreamStakes is restricted to users who are at least 18 years of age or the legal age required in their jurisdiction, whichever is greater. By using the platform, users warrant that they meet the applicable age requirements and that all information provided during registration is accurate. If StreamStakes determines that a user has misrepresented their age, their account will be immediately terminated, and all winnings forfeited. Parents or guardians who suspect unauthorized access by a minor should contact shawn@playlistgames.com to request account closure. Users acknowledge that they are solely responsible for ensuring compliance with local laws and regulations regarding participation in skill-based contests. StreamStakes may, at its discretion, offer free-to-play contests for users under the age of 18, provided that participation in such contests does not involve any form of monetary entry fees or real-money winnings. Users under 18 who engage in free-play contests must obtain parental or guardian consent, and their participation may be subject to additional restrictions. StreamStakes reserves the right to verify parental consent, restrict access to certain features, and modify or discontinue free-play contests for underage users at any time. By participating in free-play contests, users under 18 and their parents or guardians acknowledge that StreamStakes does not assume responsibility for supervising or monitoring their activity on the platform. Parents are encouraged to monitor their children’s use of online services and set appropriate usage limits.

Regulatory Compliance & Jurisdictional Restrictions

StreamStakes operates in compliance with applicable state and federal laws governing skill-based contests and reserves the right to modify contest availability based on regulatory changes. Users acknowledge that participation in certain contests may be restricted based on their geographic location. As of the latest update to these Terms, cash-based contests are prohibited in the following states: Arkansas, Connecticut, Delaware, Louisiana, Michigan, South Carolina, South Dakota, and Washington D.C. In these states, users will have access to free-play contests only. Users are responsible for understanding their local laws and agree not to access or use StreamStakes in a location where participation is restricted. StreamStakes may utilize geolocation technology to determine a user’s eligibility and reserves the right to block access to contests that do not comply with local laws.

State-Specific Rights and Disclosures

Residents of certain U.S. states, including but not limited to California, Colorado, Virginia, and others, may have additional rights under their respective state laws. These may include the right to know what personal information is collected, how it is used, and with whom it is shared; the right to access, correct, or delete personal information; and the right to opt out of the sale or sharing of personal data. StreamStakes is committed to honoring all user rights as required under applicable state laws and will comply with verified requests in accordance with regulatory requirements. Dispute Resolution and Arbitration

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes or claims arising out of or relating to these Terms or the use of StreamStakes shall be resolved by final and binding arbitration administered by a recognized arbitration authority, to take place in Harris County, Texas. By agreeing to these Terms, you waive the right to participate in any class action, class arbitration, or other representative proceeding. This arbitration clause shall survive termination of your account or access to the platform.

Intellectual Property & Content Use

All software, content, graphics, text, and branding associated with StreamStakes are the exclusive intellectual property of Playlist LLC and are protected under copyright, trademark, and other applicable laws. Users may not copy, modify, distribute, transmit, reproduce, or exploit any content, features, or game mechanics of StreamStakes without prior written consent from the Company. Unauthorized use of StreamStakes branding, including its name, logo, promotional materials, or software, for commercial or marketing purposes is strictly prohibited. Any unauthorized use of StreamStakes intellectual property may result in legal action and the immediate termination of access to the platform.

Opt-Out & Account Closure Policy

Users may request to delete their StreamStakes account and associated personal data at any time by contacting shawn@playlistgames.com or calling +1 818-672-3272. Upon receiving a deletion request, StreamStakes will permanently remove all account data, except for information legally required for fraud prevention, regulatory compliance, or financial record-keeping. Users acknowledge that account deletions are final and that once an account is closed, it cannot be recovered. Any pending contests, winnings, or account balances will be forfeited upon deletion. If a user wishes to participate in StreamStakes contests in the future, they must create a new account and re-register. StreamStakes reserves the right to deny or delay account deletion requests in cases where fraud or suspicious activity is detected.

Changes to Terms and Services

StreamStakes reserves the right to modify, suspend, or discontinue any feature or aspect of the platform at any time, with or without notice. Continued use of the Service following any such changes constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically to stay informed.

Copyright Infringement and DMCA Policy

If you believe that any content on the StreamStakes platform infringes your copyright, you may submit a Digital Millennium Copyright Act (DMCA) takedown notice to us at shawn@playlistgames.com. Your notice must include the following: (1) a description of the copyrighted work that you claim has been infringed; (2) the exact location on our platform where the alleged infringing material is located; (3) your contact information, including name, address, telephone number, and email address; (4) a statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (5) a statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
